These Terms & Conditions (“Terms”) govern your use of cushionmill.com and all purchases of custom-made cushions from The Cushion Mill (“we”, “us”, “our”). By placing an order on this website you agree to these Terms. Please read them carefully, especially the sections on custom sizing, tolerance, and our remake policy — they are different from ordinary retail returns because everything we sell is made to your measurements.
1. Who We Are
cushionmill.com is operated by The Cushion Mill. We design and manufacture cushions to each customer’s individual measurements and specifications. Questions about these Terms or your order: [email protected].
2. Our Products Are Custom-Made
Every cushion we sell is cut and sewn to the dimensions, shape, fabric, and foam density you specify in our online design tool. There are no standard sizes and no off-the-shelf items. This made-to-measure nature is the basis of the returns and remake policy in Section 7 — a cushion cut to your personal dimensions cannot be resold to anyone else.
3. Orders and Specifications
When you complete the design tool and check out, the specifications you entered (dimensions, shape, fabric, foam density, and quantity) become the binding manufacturing specification for your order. You are responsible for the accuracy of your own measurements. Please measure twice before ordering — our measuring guides explain how. If you are unsure between two sizes, contact us before ordering and we will help you decide.
4. Pricing and Payment
Prices are calculated by our design tool based on your dimensions, fabric, density, and quantity, and are shown before you add an item to the cart. The total at checkout is the total you pay. Payments are processed by PayPal; we do not see or store your card details. We may correct obvious pricing errors (for example a clear malfunction of the quote engine) and contact you before production begins.
5. Manufacturing Tolerance
Custom cushions are hand-cut and hand-sewn. We promise that finished dimensions will fall within ±½ inch (±½″) of the dimensions you ordered. Variations within this tolerance are normal for made-to-measure foam and fabric products and are not defects.
6. Production and Delivery Times
Each order is made after you place it. Typical production time is 7–14 days, followed by shipping transit time which varies by destination. These are typical estimates, not guaranteed dates; during busy periods production may take longer. If your order will be materially delayed, we will contact you.
7. Returns, Refunds, and Our Remake Policy
Because every cushion is cut to your personal dimensions, custom-made items cannot be returned, exchanged, or refunded in the way standard retail products can — unless the item you receive does not match what you ordered. Specifically:
You are covered by a free remake if, within 14 days of delivery, you report to us that your cushion:
- has actual dimensions outside the ±½″ tolerance promised in Section 5;
- was made to a different shape, fabric, or foam density than the specification in your order confirmation;
- has a manufacturing defect (for example faulty seams, wrong fill, or damage visible on arrival).
In these cases we will remake the affected item at no charge. A remake is our remedy of choice for made-to-measure goods; where a remake is not possible we will refund the affected item.
You are not covered if the cushion matches your submitted specification — including cases where the measurements you provided turn out to be wrong for your furniture, or where the fabric color or texture differs marginally from on-screen appearance (screen displays vary and fabric dye lots differ slightly). To report an issue, email [email protected] with your order number and photos of the item next to a tape measure.
8. Shipping
We currently ship to the destinations and at the rates shown at checkout. Standard shipping is a flat $29 per order, and shipping is free on orders of $149 or more. Shipping times and any import duties or taxes for destinations outside the United States are the responsibility of the customer.
9. Intellectual Property
The content of this website — text, images, design tool, and the Cushion Mill name and branding — is our property or used with permission and may not be copied or reused commercially without our consent. Your own submitted specifications remain yours; we use them only to make and deliver your order (see our Privacy Policy).
10. Limitation of Liability
To the maximum extent permitted by applicable law, our total liability for any claim arising from an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses (for example loss of use of furniture while a remake is in production). Nothing in these Terms limits rights you may have under mandatory consumer-protection law in your country of residence.
11. Governing Law
These Terms and any dispute arising from them are governed by the applicable law of the seller’s place of business, without prejudice to the mandatory consumer-protection rights of the country in which you reside.
12. Changes to These Terms
We may update these Terms from time to time. The version in force is the one published on this page at the time you place your order.
